  1. General Terms and Conditions

a. Welcome to HSM Group Holdings Limited (‘HSM’)’s website: https://hsmgroup.co.nz. Please take some time to read the following conditions applicable to the use and enjoyment of products and services provided on the site.

b. We may change or revise our terms and privacy policy from time to time, so please visit this area each time you visit the website to keep up to date with the current terms and conditions.

a. Our store website hostingis by FizzyPop Limited. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

b. Our digital marketing agencyis FizzyPop Limited. They might collect anonymous user data to improve your browsing experience, improve usability and improve the relevance of our advertising.

c. By using this site, you submit to the jurisdiction of the courts of New Zealand and agree that any legal action will only be commenced in those forums.

  1. Orders and Payments

a. All purchases are subject to the laws of New Zealand. Orders can only be placed with HSM by persons with capacity to contract.

b. All orders placed are an offer of purchase and are subject to acceptance by HSM. If an order is not accepted a full refund will occur at our earliest possible convenience. HSM reserves the right to refuse an offer of purchase for any reason.

c. HSM is a retail service for consumers and reserves the right to refuse any orders that it reasonably believes are for the purposes of resale.

d. HSM is under no obligation to ship any goods ordered until payment for those goods has been received.

e. In the event of the requested goods being unavailable, HSM may cancel the transaction and effect a full refund.

f. We will do our best to deliver within the times given, if you have any issues with your order please contact us.

g. Your credit card payment will be encrypted and processed by a secure payment gateway. We do not keep your credit card details on file. We will not be responsible for any loss or damages, direct or indirect, suffered by you if your credit card is fraudulently used or is used in an unauthorised manner by a third party.

  1. Consumer Rights

a. Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (‘CGA’) or the Fair Trading Act 1986.

b. If you are acquiring goods or services for business purposes, you agree that the CGA does not apply.

c. We will accept returns and provide remedies in accordance with New Zealand consumer law.

  1. Return/Refund Policy

a. If for any reason you have received an incorrect item, your order has not been delivered, you wish to cancel your order or you are not happy with your order, please contact customer service by email at shop@hsmgroup.co.nz, or phone: +64 06 870 8111.

b. You must notify HSM via phone or email within 24 hours of the delivery being made.

c. It may take seven working days to process a credit to your nominated account.

d. If HSM asks you to ship back the items please return them to 803 Caroline Road, Hastings 4122.

e. Please pack items securely in the packaging your product/s were delivered in. All products must be returned in good condition, in original packaging to receive full credit.

  1. Goods and Pricing

a. HSM reserves the right to change prices without notice.

b. All prices are GST inclusive and are displayed and processed in New Zealand Dollars.

c. The current price of each product is shown on the website at the time the order is placed.

d. Prices are subject to change without notice.

e. Upon purchase of goods, the buyer agrees to use the products only for their intended purpose. Any other use will cause the buyer to assume full responsibility for any loss or damage arising out of their use. Questions regarding use can be directed to HSM via the Contact page.

f. The agreement for sale is concluded only when goods are handed over to the designated carrier.

  1. Shipping

a. HSM can only ship within New Zealand as identified in our Shipping information section.

b. HSM is not responsible for any applicable customs charges and restrictions, and the purchaser remains responsible for all charges and fees incurred.

a. We comply with the Privacy Act 2020 in collecting, using, and storing personal information.

b. Our Privacy Policy explains how we handle your personal data.

c. By using our website, you consent to our collection and use of personal information in accordance with that policy.

c. The use of the information on this website is at your own risk. HSM exclude all liability in respect of any injury any damage or loss arising from the use or inability to use of the information provided on this website or through emails provided through this website, as is permitted by law.

d. You agree to indemnify HSM from any liability and all costs incurred relating to copyright infringements, defamation, invasion of privacy and trademark infringements which arise out of the use of this website and any information you provide via this website.
